1. A prerequisite for participation is the delivery of a duly completed Exhibitor Application (hereinafter the “Application”) to the Organizer. The Application shall be considered a proposal for concluding a contract between the Exhibitor and the Organizer. The Organizer independently decides on the acceptance or rejection of the proposal for concluding a contract in the form of the Application for the Exhibitor's participation in the Animefest 2026 festival (hereinafter the "Festival"). Any rejection may be made without stating a reason. The contractual relationship is established upon confirmation of the acceptance of the Exhibitor's Application, sent by the Organizer electronically to the contact email address of the Exhibitor specified in the binding Application.
2. By submitting the Application, the Exhibitor confirms agreement with the business terms and conditions for participation in the Festival and acknowledges the Personal Data Protection Principles, and undertakes to comply with them.
3. Following the acceptance of the Application, the Organizer shall send the Exhibitor an invoice with a fourteen (14) day period for the rental of the exhibition space, amounting to the total sum determined according to the completed Application. Should the invoice not be settled by the due date, the reserved exhibition space may be offered for reservation to other interested parties. Should the advance invoice not be paid even within thirty (30) days after its issuance, the Organizer reserves the right to unilaterally withdraw from the contract.
4. All further costs incurred by the Exhibitor during the Festival which are not included in the existing invoicing shall be invoiced after the conclusion of the Festival with a period of fourteen (14) days from the issuance date. This pertains primarily to costs for electricity connection and services utilized or modified by the Exhibitor during the Festival.
5. The Exhibitor is entitled to cancel the contractual relationship no later than April 20, 2026, by paying a cancellation fee (storno fee) equivalent to the advance payment pursuant to paragraph 3, in accordance with Section 1992 of Act No. 89/2012 Coll., the Civil Code, as amended. The intent to cancel the contract must be communicated to the Organizer in writing. Unless the contracting parties agree otherwise, the cancellation fee shall be offset against the paid advance. After this deadline, the Exhibitor may not terminate, withdraw from, or otherwise be released from the contract; the contracting parties specifically exclude the application of Sections 2002, 2208, 2232, and 2308 of Act No. 89/2012 Coll., the Civil Code, as amended, for this purpose. If the Exhibitor notifies the Organizer of their intent not to participate in the Festival as an exhibitor after April 20, 2026, or fails to participate without notification, this does not release them from the obligation to pay the remaining balance of the agreed price.
6. The Exhibitor is obligated to proceed in accordance with the legal regulations of the Czech Republic related to intellectual property. In case of a breach of the provisions governing ownership rights or intellectual property rights, the Organizer reserves the right to exclude the Exhibitor from participation in the Festival without the right to a refund of payments already made.
1. The exhibited items and offered services must be consistent with the focus of the Festival.
2. The amount of the fee for the rental of the exhibition space shall be calculated based on the Application completed by the Exhibitor.
3. The price for the rental of the exhibition space includes services as per the Application. If the Exhibitor requires services or equipment not ordered in advance or changes to them, the Organizer does not guarantee that the services and equipment will be available, nor the time of delivery. A supplementary invoice for services beyond the scope of the Application, including a fee for changes to the Application, will be issued after the Festival.
4. The location of the exhibition space is determined by the Organizer.
5. Should the Exhibitor fail to occupy their designated space at the Festival by the agreed deadline, the contract shall terminate, and the Organizer shall be entitled to offer the exhibition space to another exhibitor or utilize it otherwise; in this case, the original Exhibitor does not have the right to a refund of the paid rental price (nor is their obligation to pay the remaining price pursuant to Article I, paragraph 5 extinguished, should they still be in default with its payment).
6. The Exhibitor is obligated to arrive at the exhibitor registration no later than 10:30 AM on May 22, 2026, where payments will be checked, exhibitor passes will be issued, and information regarding the Festival will be provided. Subsequently, they will be directed to the exhibition space, where they will either take over the ordered construction of the exhibition stand from the Organizer or erect their own stand. Should the Exhibitor fail to arrive for registration by the specified deadline and has not made an individual agreement with the Organizer, it shall be understood that the Exhibitor has not occupied their space at the Festival by the agreed deadline (with consequences according to the preceding paragraph).
7. The Organizer is obligated to hand over the premises to the Exhibitor for use in a cleared and clean state. The Exhibitor is obligated to hand over the sales space to the Organizer in the condition in which it was provided for use, no later than 6:00 PM on May 24, 2026. In the event of a breach of this obligation, the Exhibitor is liable to pay the Organizer a contractual penalty of 50 CZK/m² per commenced hour of delay, including the time required for clearance. The right of the Organizer to claim damages is not affected by the agreement on this contractual penalty. The failure of exhibitors to liquidate the exhibition by 6:00 PM on May 24, 2026, may result in damage to the Organizer exceeding the contractual penalty agreed upon in Article II, paragraph 7. All exhibitors who fail to liquidate their exhibits are liable for compensation for such damage.
8. The Exhibitor is authorized to promote their exhibits and services only within their designated exhibition area. The placement of any advertising or promotional materials outside the exhibition area must be approved by the Organizer in advance.
9. The Exhibitor's presentation must not disturb or restrict surrounding exhibitions, and the Exhibitor is obligated to maintain order.
1. The Exhibitor is obligated to familiarize themselves with and comply with all legal regulations of the Czech Republic, technical standards, safety, and fire regulations, and is required to take effective measures to prevent damages.
2. Upon arrival at the exhibition grounds, the Exhibitor is obligated to familiarize themselves with the alarm directives, fire, and evacuation regulations, which are available on-site, and is obliged to adhere to them.
3. The Exhibitor must not store or use any flammable substances, explosives, poisons, or other health-hazardous substances in their exhibit or within the exhibition grounds. Throughout the duration of the exhibition, as well as during assembly and disassembly, a strict prohibition on smoking and handling of open flames applies within the halls.
4. The Exhibitor is obligated to check the condition of electrical appliances used. Electrical installation work may only be carried out by a person with a valid authorization for this activity. Switched-on electrical appliances must not be left unattended, and if they are subject to revisions according to other legal regulations, the Exhibitor is responsible for ensuring the respective revisions are carried out.
5. It is prohibited to pour any toxic substances or paints into drains, toilets, sinks, or washbasins.
6. The storage of residual waste material behind the stand wall outside the exhibit is prohibited.
7. The Exhibitor must not damage the installed Octanorm walls and is obligated to restore them to the condition in which they were received, specifically by removing installed promotional materials and clearing the walls of any other contamination.
8. The Exhibitor is liable for damages caused by the breach of the provisions of this contract or applicable regulations and for damages caused during their activities at the Festival to the extent provided by applicable law, and is obligated to compensate the Organizer for the damage upon the Organizer's request.
9. The Exhibitor is authorized to install the exhibition from 8:00 AM to 4:00 PM on May 22, 2026.
10. Dismantling will take place after the conclusion of the Festival, i.e., from 4:00 PM, and no later than 8:00 PM.
1. The Exhibitor is authorized to use the exhibition space only for the agreed purpose. Any other activity is subject to the Organizer's consent.
2. The Exhibitor is obligated to follow the instructions of the Organizer.
3. The Organizer reserves the right to approve any additional exhibitor (co-exhibitor) within the already leased exhibition space. In the event of a breach of this provision, the Organizer reserves the right to exclude the Exhibitor from any participation in the Festival, without the right to a refund of the paid rental fee for the exhibition space.
4. The Organizer is not responsible to the Exhibitor or co-exhibitor for any potential damage, destruction, or loss of exhibits, materials, furniture, or other property of the Exhibitor and property entrusted to them, throughout the entire duration of the event, i.e., from 8:00 AM on May 22, 2026, until 8:00 PM on May 24, 2026. The Exhibitor is responsible for all damages they cause.
5. The Organizer reserves the right to expel the Exhibitor from the Festival and withdraw from the contract without the possibility of a rental fee refund to the Exhibitor in case of a serious or repeated breach of the business terms and conditions. Should the Exhibitor fail to comply with the request to leave the Festival, they are obligated to pay a contractual penalty of 10,000 CZK, payable immediately.
6. The Organizer reserves the right to use photographs or other audio and visual recordings capturing the Exhibitor, their copyright works, directly or indirectly their exhibition space, and other assets protected by copyright law, particularly for the purpose of promoting the Organizer's subsequent events or the promotion of the Exhibitor themselves. By this contract, the Exhibitor consents to the use of the aforementioned for a period of five (5) years from the date of the Festival.
7. In the event that the Organizer is unable to hold the Festival or a part thereof due to circumstances beyond their control, they shall immediately notify the Exhibitor. This notification shall have the effect of withdrawal from the contract. In this case, the Exhibitor has the right to a full refund of the paid rental price for the exhibition space.
8. In the event that the Organizer is unable to hold the Festival or a part thereof due to governmental or similar measures in connection with the spread of infectious disease (for example COVID-19 disease caused by the SARS-CoV-19 virus), regardless of when they become aware of such reason, they shall immediately notify the Exhibitor and postpone the Festival or its part to an alternative date. The Exhibitor shall not be required to pay any costs beyond the fees under these terms and conditions, and the rental price for the exhibition space shall remain the same even if the actual costs increase (i.e., it shall be the price stated in the Application). Should the Exhibitor not agree to the postponement of the Festival, their participation will be cancelled by the Organizer, and the Exhibitor will be charged a cancellation fee of 50% of the fees they are obligated to pay under these terms and conditions, corresponding to the amount of the advance payment, for the purpose of covering the Organizer's costs. Unless the contracting parties agree otherwise, the cancellation fee shall be offset against the paid advance. In such a case, the Organizer is not liable for any damage incurred by the Exhibitor due to the postponement of the Festival or its part. This provision also applies to repeated postponement of the Festival until its actual occurrence.
9. Any complaints regarding the Organizer's services must be made immediately.
1. The Exhibitor has the right to terminate the contract with the Organizer only for the reasons and in the manner expressly stipulated in these conditions; other forms of termination are excluded (see Article I, paragraph 6 of these conditions), and must be done in written form.
2. The Organizer has the right to withdraw from the contract with the Exhibitor for reasons stipulated by law or reasons stipulated by these business terms and conditions. The Organizer is also entitled to withdraw from this contract if the Exhibitor's conduct endangers human health or poses a threat of, or has already caused, serious damage to the Festival premises. In such a case, the Organizer has the right to payment of the entire rental fee for the exhibition space as a contractual penalty, and the right to compensation for any damage remains preserved.
1. These terms and conditions are an integral part of the lease agreement concluded by the Organizer's acceptance of the Exhibitor Application.
2. The Organizer of the Festival is the registered association Brněnští otaku, z. s., Příkop 843/4, Zábrdovice, 602 00 Brno, ID No.: 22736051, VAT No.: CZ22736051, and the contact email is vendors@animefest.cz.
3. All requests for changes or requests for exemption must be sent by the Exhibitor to the Organizer via email; any exemptions shall only become effective upon agreement between the contracting parties.
